The terms that apply when you join THE EVO PROJECT, including membership access, recurring membership, use of facilities, cancellation, changes and membership administration.

These Membership Terms explain the agreement between you and THE EVO PROJECT LIMITED when you purchase or activate a gym membership. They should be read alongside the website Terms & Conditions, Booking & Cancellation Policy and Refund Policy.

02 / MEMBERSHIP

Membership options

THE EVO PROJECT may offer different membership options from time to time. The exact price, included facilities, class access and membership structure will be shown clearly before you complete your purchase.

Gym Membership

Access to the gym facilities during the applicable access times and subject to the membership terms displayed at the time of joining.

Membership features may vary between plans. The membership description presented before purchase forms part of the relevant membership arrangement.

03 / ELIGIBILITY

Joining the gym

Membership is available to people who meet the eligibility requirements shown during the joining process and who provide accurate information.

  • You must provide accurate and current contact information when joining.
  • You must use the membership only for yourself unless THE EVO PROJECT has expressly agreed otherwise.
  • You must follow the reasonable instructions, facility rules and booking requirements applicable to your membership.
  • Membership access may not be transferred, sold, shared or lent to another person without prior agreement.
04 / CONTRACT

When membership begins

The membership agreement begins when your membership purchase has been accepted and the applicable membership start requirements have been completed.

Your membership start date will be the date stated during the joining process or otherwise confirmed by THE EVO PROJECT.

If access is scheduled to begin on a future date, membership access will begin from that stated date rather than automatically from the date of purchase.

Keep your membership information

Your confirmation, membership details and applicable terms should be kept for your records.

05 / MEMBERSHIP FEES

Membership charges

The applicable membership price will be displayed before you complete your purchase.

If a membership is recurring, the frequency of the recurring charge will be stated clearly before you enter into the membership.

Membership fees apply to the membership period for which they are charged. Membership access does not automatically extend beyond the period covered by the applicable membership unless the membership terms provide for renewal.

Where a charge cannot be completed, THE EVO PROJECT may contact you to arrange resolution. Continued membership access may be affected where an amount properly due remains outstanding.

06 / RENEWAL

Recurring membership

Where you select a recurring membership, the membership will continue for successive membership periods unless it is cancelled in accordance with the applicable cancellation procedure.

The renewal frequency and recurring price will be displayed before purchase.

A recurring membership does not create a new fixed-term commitment each time it renews unless the membership information expressly states otherwise.

You may request cancellation in accordance with the cancellation terms below. Cancellation will not remove any amount that has already become properly due.

Clear renewal information The renewal arrangement, applicable price and cancellation process should be made available before you commit to a recurring membership.
07 / CANCELLATION

Cancelling your membership

You may cancel a recurring membership by following the cancellation instructions provided by THE EVO PROJECT.

Unless a different cancellation period is clearly stated for a particular membership, cancellation requests should be submitted at least 7 days before the next scheduled renewal date to allow reasonable time for administration.

Where a cancellation request is received less than 7 days before a scheduled renewal, the membership may renew for the next period and cancellation will then normally take effect at the end of that renewed period, subject to any statutory cancellation right that applies.

Statutory rights are not restricted

Nothing in these Membership Terms removes or limits a cancellation or refund right that cannot lawfully be excluded or restricted.

08 / COOLING-OFF

Cancellation after online purchase

Where a membership is purchased online by a consumer, statutory cancellation rights may apply depending on the nature of the membership and when the service begins.

Where a statutory 14-day cancellation period applies, the cancellation period normally runs from the day after the contract is entered into.

If you expressly request that membership access or another service begins during an applicable cancellation period, your statutory rights may be affected to the extent permitted by law where the service has already been supplied.

Any cancellation request made under a statutory right will be handled in accordance with the applicable consumer legislation.

09 / REFUNDS

Refunds and overpayments

Refunds are handled in accordance with the THE EVO PROJECT Refund Policy and any statutory rights that apply to your membership.

Where a membership is cancelled and an amount has been paid for a period for which you are no longer liable, any applicable refund will be processed in accordance with the relevant cancellation and refund terms.

Refunds will normally be made using the original transaction method where reasonably possible.

Refund processing may take up to 10 business days after the refund has been approved. The time for the amount to appear may then depend on the relevant financial institution.

No term in these Membership Terms is intended to exclude a refund or remedy that is required by law.

10 / ACCESS

Using your membership

Membership access is personal to the named member and may be subject to the access times, facilities and membership features shown when you join.

  • You should use the facilities responsibly and respectfully.
  • You must follow reasonable staff instructions relating to the safe and orderly use of the facility.
  • Equipment should be used for its intended purpose and returned appropriately after use.
  • Access credentials or membership identifiers should not be shared with another person.
  • Any facility-specific rules displayed at the gym form part of the requirements for using the membership.
11 / CLASSES

Group classes

Where your membership includes group classes, access is subject to the class schedule, available spaces and any booking requirements applicable to the class.

A class included in a membership does not guarantee unlimited availability where places are limited.

Class times, instructors and availability may change where reasonably necessary. Where a booked class is cancelled by THE EVO PROJECT, reasonable alternative arrangements will be considered.

Separate booking and cancellation requirements may apply to group classes. These are set out in the Booking & Cancellation Policy.

12 / PERSONAL TRAINING

Personal training is separate

Personal training sessions are separate services unless your specific membership description expressly states that a personal training session is included.

Personal training prices, session duration, booking arrangements and cancellation requirements are provided separately.

A gym membership does not by itself guarantee a personal training appointment.

13 / PAUSE

Membership pauses

A membership pause is not automatically available unless the relevant membership option expressly provides for it.

Where a pause is available, the permitted duration, eligibility requirements and effect on the membership period will be explained before the pause is confirmed.

A pause should not be assumed to cancel a recurring membership. Cancellation must be requested separately where cancellation is intended.

14 / CHANGES

Changes to facilities and services

THE EVO PROJECT may make reasonable operational changes to facilities, equipment, class times, instructors, opening arrangements or other service details.

Changes will not be used to remove the essential benefit of the membership without appropriate consideration of the member’s rights.

Where a significant change materially reduces the service included in your membership, we will provide appropriate information and, where required, offer appropriate options in accordance with applicable law.

Significant changes

We will not rely on a general right to change these terms or the membership service in a way that would unfairly alter the agreement after you have joined.

15 / PRICE

Future price changes

Membership prices may change for new memberships.

If the price of an existing recurring membership is proposed to change, the change will be communicated clearly before the new price is applied where required.

A price change will not be used to bypass any statutory cancellation or other consumer right.

Any notice period or cancellation option associated with a material price change will be handled in accordance with the applicable law and the relevant membership arrangement.

16 / CLOSURE

Temporary closure or restricted access

There may be occasions when access to part or all of the facility is temporarily restricted because of maintenance, repairs, essential works, operational requirements or circumstances outside reasonable control.

Where practical, reasonable notice will be provided for planned restrictions.

If a closure or restriction materially affects the membership service for a significant period, THE EVO PROJECT will consider appropriate arrangements having regard to the circumstances and applicable consumer rights.

17 / MEMBER RESPONSIBILITIES

Your responsibilities

To help maintain a straightforward and comfortable training environment, members are expected to:

  • provide accurate information when joining;
  • keep contact information reasonably up to date;
  • use equipment and facilities responsibly;
  • respect staff and other members;
  • follow reasonable facility and class instructions;
  • attend booked sessions on time where a booking has been made; and
  • notify THE EVO PROJECT where an issue affecting membership administration needs to be addressed.
18 / TERMINATION

Suspension or termination by us

THE EVO PROJECT may suspend or terminate a membership where there is a serious or repeated breach of these terms or the reasonable rules applicable to the facility.

Where a breach can reasonably be corrected, we will normally provide an opportunity to correct the issue before termination, unless immediate action is reasonably necessary.

Immediate restriction of access may be appropriate where necessary to protect people, property, the facility or the orderly operation of the service.

Where THE EVO PROJECT terminates a membership for a reason that is not caused by the member’s breach, any refund or other remedy due will be handled in accordance with the circumstances and applicable law.

19 / INFORMATION

Membership information

Membership information is handled in accordance with the THE EVO PROJECT Privacy Policy.

We may use your contact details to administer your membership, communicate important service information, respond to enquiries and manage bookings connected with your membership.

Marketing communications are handled separately where consent or another appropriate lawful basis is required.

20 / HOW TO CANCEL

Cancellation process

Cancellation should be made using the cancellation method specified by THE EVO PROJECT.

Submit your request Send your cancellation request through the available cancellation channel.

Confirmation We will review the request and confirm the applicable cancellation date.

Membership end Access will continue until the confirmed membership end date unless an earlier end date is required by law.

Final administration Any applicable refund, overpayment or outstanding administration will then be dealt with under the relevant terms.

If you have a question or concern about your membership, please contact THE EVO PROJECT so that the matter can be reviewed.

We aim to handle membership enquiries clearly and reasonably and to provide an appropriate response within a reasonable period.

22 / YOUR RIGHTS

Your legal rights

These Membership Terms operate alongside your statutory rights as a consumer. Nothing in these terms is intended to exclude, restrict or replace a legal right or remedy that cannot lawfully be excluded or restricted.

If a term conflicts with a mandatory consumer protection requirement, the applicable legal requirement will prevail to the extent of that conflict.

Membership terms will be interpreted and applied in a manner consistent with applicable UK consumer protection requirements.

24 / UPDATES

Changes to these terms

We may update these Membership Terms where reasonably necessary to reflect changes to our services, facilities, operational arrangements or applicable legal requirements.

Changes will not be used to remove statutory rights or to introduce a materially different obligation without appropriate notice and, where required, the opportunity for the member to end the relevant arrangement.

The version available on this website will contain the current Membership Terms.

Changes that materially affect an existing membership will be communicated appropriately before they take effect where required.
