These Terms & Conditions apply to the use of the THE EVO PROJECT website and to purchases, memberships, bookings and services arranged through THE EVO PROJECT LIMITED.
By using the website, placing an order, purchasing a membership, making a booking or otherwise entering into a service agreement with THE EVO PROJECT, you agree to the terms that apply to the relevant service.
Separate Membership Terms, Booking & Cancellation Policy and Refund Policy may contain additional information for specific services. Where those terms apply, they form part of the relevant agreement.

What we provide

Gym Membership
Membership provides access to the facilities and services included within the membership selected at the time of joining.
Personal Training
Individual sessions are arranged according to the selected session type, available times and confirmed booking.
Group Classes
Group sessions are offered according to the published timetable and available class capacity.

Selected memberships and services may be purchased or booked through the website.
When an agreement begins
A contract for a particular service is formed when the relevant purchase or booking has been accepted and confirmed by THE EVO PROJECT.
For online purchases, the information shown during the purchase process, the applicable service terms and the confirmation issued to the customer together form the relevant contractual information.
THE EVO PROJECT may decline or cancel a transaction where there is a genuine operational, technical or availability reason to do so. Where a confirmed purchase cannot be provided and a refund is due, the Refund Policy will apply.
Prices and charges
Prices displayed on the website are the prices applicable to the relevant service at the time of purchase unless otherwise stated.
Any applicable recurring charge, booking charge or other mandatory amount should be made clear before the customer completes the relevant purchase.
THE EVO PROJECT aims to display prices accurately and transparently. If an obvious pricing or technical error is identified before an order is accepted, the customer will be contacted where appropriate.

Gym Membership
Membership is subject to the separate Membership Terms, which explain membership periods, renewal, cancellation, access and other membership arrangements.
The membership type selected by the customer determines the facilities and services included within that membership.
A customer must not allow another person to use their membership or access credentials unless THE EVO PROJECT expressly permits this.
Membership cancellation does not automatically cancel separate Personal Training or Group Class bookings. Those bookings are governed by the Booking & Cancellation Policy.
Personal Training and classes
Personal Training and Group Class bookings are subject to availability.
- A booking is confirmed only when the booking process has been completed and confirmation has been issued.
- Personal Training sessions are subject to trainer availability.
- Group Classes are subject to the available class capacity.
- Customers should check the date and time shown in their confirmation.
- Changes and cancellations are governed by the Booking & Cancellation Policy.
Cancelling a service
Customers may cancel memberships, bookings or other services in accordance with the terms applicable to that service.
Personal Training and Group Class cancellations are subject to the notice periods set out in the Booking & Cancellation Policy.
Membership cancellation is subject to the Membership Terms.
Where a statutory cancellation right applies to an online contract, that right is not removed by these Terms & Conditions.
Refunds
Refunds are handled in accordance with the Refund Policy applicable to the relevant service.
- Approved refunds are normally processed within 10 business days.
- Refunds are normally returned using the original purchase method.
- Where the original purchase method cannot receive a refund, a reasonable alternative method may be arranged after appropriate verification.
- The time taken for a refund to appear in an account may depend on the relevant bank, card issuer or account provider.
- Nothing in these terms removes a statutory refund right.
Booking cancellation notice
Unless a different arrangement is clearly stated for a particular service, customers should provide at least 24 hours’ notice when cancelling or requesting a change to a Personal Training or Group Class booking.
A cancellation made less than 24 hours before the scheduled start time may be treated as a late cancellation and may not qualify for a refund or replacement session.
This arrangement exists to manage reserved session capacity and is not intended to create a disproportionate cancellation charge.
Arriving and attending
Customers are responsible for arriving in sufficient time for their scheduled session or class.
If a customer arrives late, the session may still need to finish at the originally scheduled time so that later bookings are not affected.
If a customer does not attend a confirmed booking and provides no reasonable notice, the booking may be treated as a no-show under the Booking & Cancellation Policy.
Use of the gym
Customers must use THE EVO PROJECT facilities reasonably, respectfully and in accordance with any instructions displayed at the premises.
- Equipment should be used only for its intended purpose.
- Equipment should be returned or left in the appropriate condition after use.
- Customers should follow reasonable staff instructions concerning use of the facilities.
- Customers must not deliberately damage equipment, fixtures or other property.
- Customers must not interfere unreasonably with other customers’ use of the facilities.
Using the facilities responsibly
Customers are responsible for deciding whether a particular activity or session is appropriate for them and should follow the instructions provided during training.
Customers should communicate relevant information to the trainer where it is reasonably necessary for the trainer to deliver the agreed session appropriately.
THE EVO PROJECT does not provide individual professional advice through general website content. Customers should obtain independent professional advice where they consider that such advice is appropriate before undertaking an activity.
Reasonable conduct
THE EVO PROJECT may give reasonable instructions relating to the use of the facilities, equipment, bookings and general operation of the gym.
Customers are expected to follow reasonable instructions designed to maintain an orderly and usable environment.
Where a customer repeatedly or seriously disregards reasonable instructions, THE EVO PROJECT may review or restrict access in accordance with the Membership Terms and applicable rights.
Changes to facilities or services
Gym facilities, class timetables, trainers, opening arrangements and available services may occasionally change because of operational requirements.
THE EVO PROJECT will aim to provide reasonable notice of material changes where it is practical to do so.
Where a significant change materially affects a service already purchased, THE EVO PROJECT will consider an appropriate alternative arrangement or refund where applicable.
Temporary closure or restricted access
The gym or particular facilities may occasionally become unavailable for maintenance, operational requirements, safety reasons or circumstances outside the reasonable control of THE EVO PROJECT.
Where a closure materially affects a prepaid service, THE EVO PROJECT will consider a reasonable alternative arrangement or refund for the affected unused service, subject to the circumstances.
Customers will not be required to accept an arrangement that conflicts with a mandatory statutory right.
Changes to membership prices
THE EVO PROJECT may review its membership prices from time to time.
Any future price change affecting an existing recurring membership will be communicated before the new price applies.
Customers will be given reasonable information about the revised price and the date from which it applies.
Where a customer has a contractual right to cancel because of a price change, the relevant cancellation arrangement will be provided clearly.
Recurring membership
Where a membership renews on a recurring basis, the customer will be told before joining that the membership continues according to the relevant membership arrangement.
The customer can cancel the membership in accordance with the Membership Terms.
Cancellation procedures should be reasonably accessible and customers should not be required to follow an unnecessarily complicated process.
The membership structure, recurring nature and cancellation process should be understood before the customer completes the relevant purchase.

Where access is restricted because of a customer’s conduct, the Membership Terms may provide further information about suspension or termination.
Where access is restricted for operational reasons unrelated to the customer, THE EVO PROJECT will consider an appropriate arrangement for any materially affected prepaid service.
Ending an agreement
A service agreement may end when the relevant service period finishes, when a valid cancellation takes effect or when either party has a lawful right to terminate the agreement.
Where THE EVO PROJECT terminates a service without customer fault and prepaid services remain unused, the business will consider any refund that is due for those unused services.
Where termination follows a serious or repeated breach of applicable terms by a customer, the Membership Terms or relevant service terms may apply.
Personal information
Information supplied through the website, membership process, booking system or contact channels may be handled in accordance with the Privacy Policy.
